These Terms of Service (“Terms”) are a legally binding agreement between you and Hamper Delivery LLC, doing business as Hamper Laundry & Dry Cleaning (“Hamper,” “we,” “us,” or “our”).
These Terms govern your access to and use of Hamper’s websites, web and mobile applications, pickup and delivery services, dry cleaning, laundry, wash-and-fold, laundering and pressing, alterations, kiosks, lockers, commercial services where no separate written agreement controls, and other services provided by Hamper (collectively, the “Services”).
Please read these Terms carefully.
BY CREATING A HAMPER ACCOUNT, SCHEDULING OR SUBMITTING AN ORDER, USING A HAMPER KIOSK OR LOCKER, OR OTHERWISE USING THE SERVICES, YOU AGREE TO THESE TERMS.
If you do not agree, do not use the Services.
You must be at least 18 years old and legally capable of entering into a binding contract to create a Hamper account or place an order.
If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.
Hamper provides services that may include:

Hamper may add, modify, suspend, or discontinue services at any time, subject to applicable law and any existing contractual commitments.
Hamper may perform Services directly or through affiliated or independent:
By submitting items to Hamper, you authorize Hamper to use qualified third parties when reasonably necessary to fulfill your order.
Hamper remains responsible for customer service concerning orders placed with Hamper, subject to these Terms.
You agree to provide accurate and current account information.
You are responsible for:
You must promptly notify Hamper if you believe your account has been compromised.
We may suspend access when reasonably necessary to protect customers, Hamper, payment providers, or the Services.
An order may be created through a Hamper application, website, kiosk, locker, customer-support interaction, recurring service arrangement, commercial arrangement, or another authorized method.
The customer is responsible for selecting the appropriate service and providing relevant care instructions.
Hamper may inspect and classify items after pickup.
The final classification of an item may differ from the category initially selected by a customer when necessary to accurately reflect the garment, material, cleaning method, specialty handling, or other characteristics.
If an item requires materially different pricing or specialized treatment, Hamper may contact you before processing it.
Prices are based on Hamper's then-current pricing unless a separate written agreement or promotion applies.
Prices may vary based on:
Applicable taxes, fees, tips, minimums, and other charges may be added when disclosed.
Hamper may change pricing prospectively at any time.
Pricing changes will not retroactively alter a completed order unless an obvious pricing error occurred or the submitted item was reasonably classified incorrectly before physical inspection.
By providing a payment method, you authorize Hamper and its payment processor to charge amounts owed under these Terms, including:
You represent that you are authorized to use the payment method provided.
If a payment is declined, reversed, disputed, or otherwise unpaid, Hamper may suspend further Services and pursue amounts legitimately owed.
Hamper may correct billing errors and issue refunds or credits when appropriate.
Hamper may offer memberships, subscriptions, recurring laundry plans, prepaid service plans, or similar programs.
The price, included services, weight allowances, billing cycle, renewal terms, cancellation rules, and other material terms of a plan will be disclosed at enrollment.
Unless expressly stated otherwise, a recurring plan will renew automatically at the disclosed interval until canceled.
By enrolling, you authorize Hamper to charge the payment method on file at each renewal.
You may cancel a recurring consumer plan through any cancellation method Hamper makes available for that plan or by contacting customer support.
Unless otherwise disclosed or required by law, cancellation becomes effective at the end of the then-current paid billing period, and partial billing periods are not automatically prorated.
Unused allowances, credits, pounds, pickups, or other plan benefits expire according to the terms disclosed for the applicable plan.
Hamper will not materially change an existing recurring plan in a manner requiring additional consent under applicable law without obtaining that consent.
You are responsible for making items reasonably accessible at the scheduled pickup location.
For an attended pickup, Hamper takes custody when the items are physically transferred to our driver or representative.
For an unattended pickup, including an item left:
Hamper generally takes custody when our driver or authorized representative physically retrieves the item.
Hamper is not responsible for theft, loss, weather exposure, animal damage, building personnel, or other events affecting an unattended order before Hamper takes custody of it.
Customers should not leave an order unattended unless they accept the risks associated with doing so.
You may authorize Hamper to deliver an order:
When you request or permit unattended delivery, you authorize Hamper to leave the order at the designated location.
Except where prohibited by law, Hamper's custody of an order ends when:
Hamper is not responsible for theft, loss, weather exposure, building personnel, animals, or other events occurring after custody ends.
Pickup dates, delivery dates, arrival windows, turnaround times, and estimates are estimates rather than guarantees unless Hamper expressly agrees otherwise in writing.
Delays may occur because of:
Hamper will make commercially reasonable efforts to communicate significant delays.
If you use a Hamper kiosk or locker, you are responsible for following the instructions displayed or otherwise provided.
You must ensure that:
Hamper is not responsible for items left:
Kiosk and locker availability may be affected by building management, property access, power, network availability, equipment maintenance, or other third-party conditions.
Hamper will use commercially reasonable garment-care practices appropriate to the selected service and item.
Garment cleaning involves inherent risks.
Certain problems may result from characteristics of the item rather than improper cleaning, including:
Hamper cannot guarantee that every stain can be removed safely.
We may decline aggressive stain removal when we reasonably believe further treatment could damage an item.
Hamper may rely on manufacturer care labels when selecting a cleaning process.
If:
Hamper may decline the item, request authorization, select a reasonably appropriate method, or require you to acknowledge additional risk before proceeding.
Customers are responsible for removing all personal property before submitting items.
This includes:
Hamper is not responsible for personal property left inside pockets, bags, or garments except to the extent required by law.
Items left in pockets may also damage the customer's items or other customers' items.
You may be responsible for damage caused by hazardous, leaking, staining, sharp, flammable, or otherwise inappropriate objects submitted with an order.
Wash-and-fold service is generally processed by weight rather than by individually inventorying every item.
Unless otherwise specifically agreed, Hamper does not record every sock, undergarment, towel, shirt, or other individual article contained in a wash-and-fold bag.
Although we use reasonable procedures to keep orders separated, individual-item tracking is inherently more limited in a bulk laundry service.
Hamper does not guarantee:
Customers should not submit unusually valuable, irreplaceable, sentimental, dry-clean-only, leather, suede, embellished, or otherwise specialty items in a wash-and-fold bag.
Alterations may involve judgment concerning fit, length, style, fabric behavior, and customer preference.
Customers are responsible for communicating their requested alteration accurately.
If a fitting is required, Hamper may require the customer to participate in a fitting before work begins.
Alteration disputes must be reported promptly after delivery so that Hamper has a reasonable opportunity to inspect and, where appropriate, correct the work.
If you believe an item was not cleaned or finished properly, contact Hamper within seven (7) days after delivery.
Where reasonably appropriate, Hamper's first remedy will be to inspect and re-clean, re-press, repair, or otherwise attempt to correct the item at no additional service charge.
Customers must give Hamper a reasonable opportunity to inspect and attempt correction before seeking reimbursement for an alleged cleaning defect.
The re-cleaning policy does not apply to:
A claim involving an allegedly lost or damaged individually processed item must be submitted to Hamper within seven (7) days after delivery of the order, or within seven days after the date the customer reasonably should have discovered the issue, where applicable law requires a later period.
The customer must provide information reasonably necessary to evaluate the claim, which may include:
Hamper may require physical inspection of an allegedly damaged item.
A submitted claim does not constitute an admission of liability.
When Hamper accepts responsibility for loss of or damage to an individually processed garment, compensation will be based on the item's reasonable depreciated value immediately before the loss or damage, rather than its original purchase price or the cost of purchasing a brand-new replacement.
Factors may include:
Hamper may use the Drycleaning & Laundry Institute Fair Claims Guide or a comparable textile-industry methodology as a reference when determining depreciated value.
Except where prohibited by law or separately agreed in writing before Hamper accepts custody of the item, Hamper's maximum liability for an individually processed item is $500 per item and $1,000 per order.
These limits do not increase because an item has sentimental, collectible, emotional, or special personal value.
An item with an actual or claimed value exceeding $500 must be disclosed to Hamper before Hamper accepts custody.

Unless Hamper expressly accepts a higher declared value in writing before taking custody, the ordinary liability limits in these Terms remain applicable.
Because wash-and-fold items are processed as a bulk load and are not ordinarily individually inventoried, any claim for lost wash-and-fold items will be evaluated based on the circumstances of the load.
Except where prohibited by law, Hamper's aggregate liability for items alleged to be missing from a wash-and-fold order will not exceed the lesser of:
The limitation does not apply to conduct for which liability cannot lawfully be limited.
Customers should use individually itemized garment-care services rather than wash-and-fold service for items requiring individual chain-of-custody documentation.
Hamper may resolve an approved claim through one or more of the following:
If Hamper pays the full depreciated value of a damaged item, Hamper may require surrender of the damaged item where legally permissible.
Customers are responsible for accepting delivery and maintaining valid contact and payment information.
If Hamper cannot return an order after repeated reasonable attempts, we may store the order for a reasonable period.
Hamper may charge reasonable storage, redelivery, or administrative fees where disclosed and permitted by law.
Items remaining unclaimed for an extended period may be treated as abandoned in accordance with applicable law.
Promotional offers, discounts, referral credits, account credits, or coupons may have separate eligibility requirements and expiration dates.
Unless expressly stated otherwise:
Hamper may modify or discontinue a promotion prospectively.
By providing a mobile telephone number, you authorize Hamper to send service-related communications reasonably necessary to administer your account and orders.
These may include:
If you separately consent to marketing messages, Hamper may also send promotional texts consistent with that consent and applicable law.
Consent to promotional automated text messages is not a condition of purchasing Services.
Message frequency may vary.
Message and data rates may apply.
You may opt out of promotional automated texts by replying STOP, UNSUBSCRIBE, or otherwise communicating a reasonable request to stop such messages.
The Services may integrate with third-party platforms such as payment processors, mapping services, delivery platforms, authentication systems, or other technologies.
Hamper is not responsible for independently operated third-party products or services except to the extent required by applicable law.
Your use of third-party services may be governed by separate third-party terms.
The Hamper name, logos, applications, websites, software, graphics, design elements, content, photographs, text, and other intellectual property are owned by Hamper or its licensors and are protected by applicable intellectual property laws.
Subject to these Terms, Hamper grants you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended personal or authorized business purpose.
You may not:

Hamper may refuse or terminate service for violations of this section.
Hamper will use commercially reasonable efforts to provide professional garment-care services.
However, to the fullest extent permitted by law, the Services are provided without warranties not expressly stated in these Terms.
Hamper does not warrant that:
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
The garment-specific claim provisions above govern loss of or physical damage to customer garments and textiles.
For other claims, to the fullest extent permitted by law, Hamper and its owners, officers, employees, affiliates, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits or loss of business opportunity, arising from use of the Services.
For a consumer claim not governed by the garment-specific claim provisions and for which liability may lawfully be limited, Hamper's aggregate liability will not exceed the greater of:
These limitations do not apply where applicable law prohibits limitation of the particular liability.
To the extent permitted by law, you agree to indemnify and hold Hamper harmless from third-party claims, damages, liabilities, or expenses arising from:
This provision does not require a consumer to indemnify Hamper for Hamper's own negligence or misconduct where such indemnification is prohibited by law.
Before filing a formal legal claim against Hamper, you agree to make a reasonable good-faith effort to resolve the dispute informally.

The parties will attempt in good faith to resolve the dispute for at least 30 days before either party initiates arbitration, except when immediate relief is reasonably necessary.
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
Except for disputes eligible for small-claims court and claims seeking qualifying injunctive relief concerning misuse of intellectual property, you and Hamper agree that disputes arising from or relating to these Terms or the Services will be resolved through binding individual arbitration rather than a lawsuit in court, to the fullest extent permitted by law.
The Federal Arbitration Act governs the interpretation and enforcement of this arbitration provision.
Arbitration will be administered by the American Arbitration Association (“AAA”) under the rules applicable to the dispute, including applicable Consumer Arbitration Rules when the claimant is a consumer.
Arbitration may occur remotely, by documents, or at a reasonably convenient location, as permitted by the applicable rules.
The arbitrator may award any individual remedy that would otherwise be available in court.
Either party may bring an individual claim in a court of competent jurisdiction that qualifies as a small-claims matter instead of arbitration.
To the fullest extent permitted by law, disputes must be brought on an individual basis.
Neither you nor Hamper may pursue a claim as:
The arbitrator may award relief only to the individual party seeking relief and only to the extent necessary to resolve that individual's claim.
You may opt out of this arbitration agreement by emailing:
within 30 days after the date you first become subject to these Terms.

Your notice must include your name, account email address or phone number, and an unambiguous statement that you wish to opt out of the arbitration provision.
Opting out of arbitration will not affect your ability to use Hamper.
Except to the extent federal law or another applicable law requires otherwise, these Terms and disputes not subject to arbitration are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
For disputes permitted to proceed in court and not eligible for another mandatory venue, the parties consent to jurisdiction in state or federal courts located in Harris County, Texas.
You may stop using the Services at any time, subject to outstanding payment obligations.
Hamper may suspend or terminate an account when reasonably necessary because of:
Sections that by their nature should survive termination will remain effective, including payment obligations, claim limitations, intellectual property provisions, disclaimers, dispute-resolution provisions, and limitations of liability.
Hamper may update these Terms from time to time.
The current version will identify its effective date.
Material changes may be communicated through the website, application, email, account notice, or another reasonable method.
Changes will apply prospectively unless otherwise permitted by law.
If applicable law requires affirmative consent to a particular change, Hamper will obtain that consent before the change becomes binding on the affected customer.
Commercial, corporate, property-management, hospitality, medical, retail, institutional, and similar customers may enter into separate written agreements with Hamper.
If a separate written agreement conflicts with these Terms, the separately signed written agreement controls to the extent of the conflict.
If a provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect to the fullest extent permitted by law.
Hamper's failure to enforce a provision of these Terms does not waive the right to enforce it later.
These Terms, together with the Privacy Policy and any applicable order-specific, subscription-specific, promotion-specific, or separately executed commercial terms, constitute the agreement between you and Hamper concerning the Services.
